Article 2 - PAYMENT METHODS

Our payment system by credit card is 3D secure.

If you already have a PayPal account:

You can carry out your payment thanks to this protected system which makes the link between our site and your bank, your banking data do not pass in transit on our site.

If you do not have a PayPal account:

In order to avoid any inconvenience, we recommend that you pay by credit card, which is just as secure, easier and faster. According to the feedback we have from our customers, the Paypal system can seem cumbersome to implement and it is quite frequent that a first transaction fails, especially when it is issued outside Belgium.

Article 3 - DELIVERY

Treatment of the orders:

Our logistics provider processes them before noon, every working day.

Your parcel is collected by La Poste between 15H00 and 16H00 from Monday to Friday.

You will receive your tracking number in your order space which will allow you, to follow the progress of your order.

Weekend orders:

All orders placed on weekends (from Friday 11H to Sunday included) will be processed on Monday morning.

Shipping methods, delivery times & rates

We ship anywhere in the world, depending on the shipping method proposed and selected by you (the customer)

Means of delivery

When you place your order, please make sure to fill in the "address" fields correctly, taking care not to overlook any details so that your order will be delivered correctly to your home and to help the deliveryman to deliver your package within the time limit set.

Thus, do not hesitate to indicate the access codes (digicode), name of building or residence, number of building or any particularities concerning your address in order to guarantee a fast delivery at your residence.

AnimalsVit could not be held responsible for any false or incomplete address not allowing the delivery of the parcel as well as for any theft or deterioration of your parcel.

CAUTION : We reserve ourselves the right to delay the forwarding of a parcel when the address seems to us ambiguous or incomplete. In this case, we will do everything possible, as quickly as possible, to obtain details by email (complaint@animalsvit.com): 48 hours of delay are better than a lost package!

The delivery periods are given as an indication by the various means of deliveries and get along starting from the sending of the order by our provider of delivery.

AnimalsVit could not be held for person in charge of the delays due to movements of strike of the postal services or other imponderables envisaged by the legislation on the transport of goods and goods.

Article 5 - RETURN OF GOODS, or problems related to orders

In accordance with the legislation in force, you have a period of 14 days (from the date of receipt) to request an exchange or refund of your order.

We remind you that the costs of returning goods are at the customer's expense.

Your return package must imperatively contain:

• The product returned intact and complete (not used, not damaged and in its original packaging, without having been opened)
• The invoice of your order (specify if you wish an exchange or a refunding)

The AnimalsVit company reserves the right to refuse your return if these conditions are not respected.

Article 6 - RESPONSIBILITY

The products offered are in accordance with the Belgian legislation in force and the standards applicable in Belgium.

Animalsvit could not be held for person in charge of the non-fulfilment of the contract concluded in the event of shortage of stock, problem of synchronization of inventory with our logistic provider or unavailability of the product, force majeure, disturbance or all-out or partial strike in particular of the postal services and means of transport and/or communications, flood, fire.

Article 7 - NAME INFORMATION

Animalsvit  is committed not revealing with thirds the information which you communicate to us. These are confidential. They will be used by its internal services only for the treatment of your order and to personalize the communication and the product offer reserved for the customers Animalsvit.

The present article will not be able to prevent the global transfer of the company nor the transfer of activities to a third party.
In accordance with the data-processing law and freedoms of January 6, 1978, you have, constantly, of a right of access, correction and opposition to the personal data concerning you.

To do so, simply send us a request online or by e-mail to complaint@animalsvit.com providing proof of your identity and indicating your last name, first name, address and your customer reference.

All the texts, comments, works, illustrations and images reproduced on the sites published by Animalsvit are reserved under the copyright as well as under the intellectual property and for the whole world. For this reason and in accordance with the provisions of the Code of the Intellectual property, only is authorized the use for a private use subject to provisions different even more restrictive from the code of the intellectual property.

Any other use is constitutive of counterfeit and sanctioned under the Intellectual Property except prior authorization of Animalsvit.

Article 9 - DISPUTES

The present contract is subject to Belgian law.
Any dispute settlement can be made with our customer service complaint@animalsvit.com, and in the absence of an amicable settlement, it will be the competence of the competent court.

Article 10 - CUSTOMER COMMITMENT

When you validate your purchase on the order module, you declare to accept its contents as well as the general conditions of sale Animalsvit which are governed by the Belgian law.

These general conditions of sale are governed by the Belgian right and can be modified at any time without notice.

Article 11 - PRECAUTION OF USE OF THE PRODUCTS

Our products are exclusively intended for the animal use.

Any total or partial reproduction of the site www.animalsvit.com, of the images, texts or animations Flash or 3D is strictly prohibited and in the event of not authorized use, Animalsvit will engage irremediably legal proceedings.

Article 12 - GUARANTEES

The user profits for the articles of a guarantee allowing him to send back the defective articles delivered in accordance with the articles L 211-4 and following of the Code of the consumption.

The legal guarantee of the goods of conformity of 2 years is applicable.

Animalsvit  is a company registered at the trade register of Brussels under the name of « HEALTH 1.618 B.V » and under the number of VAT: BE0787.426.697, whose registered office is domiciled at 4 rue de la Presse, 1000 Brussels - Belgium.

Appendix :

Article L. 217-4 :
"The seller delivers a good in conformity with the contract and is responsible for defects of conformity existing at the time of delivery.
He is also liable for defects in conformity resulting from the packaging, the assembly instructions or the installation when the latter was made his responsibility by the contract or was carried out under his responsibility."

Article L. 217-5 :
"The good is in conformity with the contract: 1° If it is fit for the use usually expected of a similar good

and, if applicable:
- if it corresponds to the description given by the seller and has the qualities that the seller presented to the buyer in the form of a sample or model;
- if it has the qualities that a buyer can legitimately expect in view of the public statements made by the seller, the producer or his representative, in particular in advertising or labelling;
2° Or if it has the characteristics defined by mutual agreement between the parties or is fit for any special purpose sought by the buyer, brought to the attention of the seller and accepted by the latter."

Article L. 217-6 :
"The seller is not bound by the public statements of the producer or his representative if it is established that he did not know them and was not legitimately in a position to know them."

Article L. 217-7 :
"Defects of conformity that appear within twenty-four months from the delivery of the goods are presumed to exist at the time of delivery, unless proven otherwise.
For goods sold second-hand, this period is set at six months
The seller may fight this presumption if it is not compatible with the nature of the good or the claimed lack of conformity."

Article L. 217-8 :
"The buyer is entitled to demand the conformity of the good to the contract. However, he may not contest the conformity by invoking a defect that he knew or could not ignore when he contracted. The same applies when the defect has its origin in the materials that he himself has supplied."

Article L. 217-9 :
"In case of lack of conformity, the buyer chooses between repair and replacement of the good. However, the seller may not proceed according to the buyer's choice if this choice entails a cost that is clearly disproportionate to the other method, given the value of the goods or the importance of the defect. He is then obliged to proceed, unless it is impossible, according to the method not chosen by the buyer."

Article L. 217-10 :
"If repair and replacement of the good are impossible, the buyer may return the good and have the price returned or keep the good and have part of the price returned. The same option is open to him: 1° If the solution requested, proposed or agreed upon in application of article L. 217-9 cannot be implemented within a period of one month following the buyer's complaint; 2° Or if this solution cannot be implemented without major inconvenience for the buyer, given the nature of the good and the use he is seeking. However, the sale cannot be cancelled if the lack of conformity is minor.

Article L. 217-11 :
The application of the provisions of Articles L. 217-9 and L. 217-10 takes place without any cost to the buyer. These same provisions do not prevent the awarding of damages.

Article L. 217-12 :
"The action resulting from the lack of conformity is prescribed by two years from the delivery of the goods."

Article L. 217-13 :
"the provisions of this section do not deprive the buyer of the right to exercise the action resulting from redhibitory defects as it results from articles 1641 to 1649 of the civil code or any other action of a contractual or extra-contractual nature that is recognized by law."

Article L. 217-14 :
"The recourse action may be exercised by the final seller against successive sellers or intermediaries and the producer of the tangible personal property, according to the principles of the Civil Code.

Article L. 217-15 :
"The commercial guarantee means any contractual commitment by a trader to the consumer to reimburse the purchase price, replace or repair the good or provide any other service in relation to the good, in addition to his legal obligations to guarantee the conformity of the good.

The commercial guarantee is the subject of a written contract, a copy of which is given to the buyer. The contract specifies the content of the warranty, the terms of its implementation, its price, its duration, its territorial scope and the name and address of the guarantor.
In addition, it clearly and precisely mentions that, independently of the commercial guarantee, the seller remains bound by the legal guarantee of conformity mentioned in articles L. 217-4 to L. 217-12 and that relating to defects in the thing sold, under the conditions provided for in articles 1641 to 1648 and 2232 of the civil code.
The provisions of articles L. 217-4, L. 217-5, L. 217-12 and L. 217-16 as well as article 1641 and the first paragraph of article 1648 of the Civil Code are reproduced in full in the contract.
In the event of non-compliance with these provisions, the warranty shall remain valid. The purchaser is entitled to avail himself of it."

Article L. 217-16 :
"When the buyer asks the seller, during the course of the commercial guarantee that was granted to him at the time of the acquisition or repair of a movable good, for a repair covered by the guarantee, any period of immobilization of at least seven days is added to the duration of the guarantee that remained to run.
This period shall run from the date of the buyer's request for intervention or from the time the item in question is made available for repair, if this availability is subsequent to the request for intervention."

"The action resulting from redhibitory defects must be brought by the purchaser, within two years from the discovery of the defect. In the case provided for in article 1642-1, the action must be brought, under penalty of foreclosure, within one year of the date on which the seller may be relieved of the defects or lack of conformity".
